Patent & Deisgn Protection
St Helena Patents have a duration for as long as the UK patent is in force. No renewal fees are payable. St Helena is a member of the Paris Convention (International treaty for the protection of Industrial Property) and the PCT (Patent Cooperation Treaty).
Types of Patents:
- Registration of a granted UK or European (validated in the UK) patent.
Filing Requirements:
Only patents based on UK or European (validated in the UK) registrations can be registered in St Helena.
- Simply signed Power of Attorney (required upon filing)
- 2 copies of the UK or European (validated in the UK) patent (required upon filing)
Novelty:
Applications must be lodged within 3 years of grant of the UK or European (validated in the UK) patent.
Examination:
None

A UK design will automatically extend to St Helena without re-registration.
