Ethiopia Patents

Patent & Design Protection

Ethiopia patents have a duration duration of 15 years from date of filing but can be extended by a further 5 years if the invention is properly worked. A patent of Importation/Introduction expires when the patent off which it is based expires (maximum term of 10 years). Annual renewal fees are payable, in advance, every year from the first anniversary of the filing date.

Filing Requirements:

Non-PCT applications:

  • Power of Attorney, legalised (must be filed within 1 month of filing date)
  • Specification, claims, drawings and abstract in English (required upon filing)
  • International Patent Classification (required upon filing)
  • Deed of assignment, legalised (must be filed within 2 months of filing date)
  • Certificate of Incorporation, legalised
  • Certified copy of the priority document (if applicable) with verified English translation (must be filed within 3 month of filing date)

Patents of Importation/Introduction:

  • Power of Attorney, legalised (must be filed within 1 month of filing date)
  • Specification, claims, drawings and abstract in English (required upon filing)
  • Certificate of Incorporation, legalised
  • Certified copy of foreign granted patent (required upon filing)

Novelty:

Absolute novelty required.

Patentability:  

Methods of medical diagnosis, treatment or surgery are not patentable.

Examination: 

Automatically proceed to substantive examination.

Duration/Renewals:

Designs in Ethiopia

Types of Designs:

  • Industrial Designs

Filing Requirements:

  • Power of Attorney, legalised (must be filed within 1 month of filing date)
  • Drawings or photographs of the design (required upon filing)
  • A statement indicating the kind of products for which the design is to be used (required upon filing)
  • Certified copy of priority document (if applicable) with English translation (must be filed within 3 months of the filing date)
  • Deed of assignment, legalised (can be late filed).

Duration/Renewals:

The design has an initial term of 5 years from date of filing, with possible extensions of 2 further terms of 5 years each. In addition to paying the 5 year extension fees, annual renewal fees are also payable every year from the first anniversary of the filing date (in advance).

International and Regional Systems:

  • None, although priority can be claimed from a foreign application filed within the last 6 months.
